The petitioner seeks bail in anticipation of his arrest in connection with Muffasil (Ujiyarpur) P.S. Case No. 46 of

2020, dated 16.02.2020, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It appears from the First Information Report that 35.64 litres of liquor was recovered from a kirana shop. The petitioner contends that he has no concern with either the consignment of liquor which was seized or the shop from where it was seized. The shop in question belongs to one Nageshwar Singh, who is the uncle of the petitioner. The petitioner claims to be a person of clean antecedent. Considering the facts afore-stated, the petitioner abovenamed, in the event of his arrest/surrender before the Court below within a period of eight weeks from today, is directed to be released on bail on his furnishing bail-bond in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II-cum-Special Judge, Excise Act, Samastipur in connection Muffasil (Ujiyarpur) P.S. Case No. 46 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
