One to many opportunities have been given to the petitioner to satisfy the authorities that he meets the minimum standards laid down in physical test for recruitment on the post of Sub-Inspector of Police in the State of Bihar with regard to Advertisement No. 704 of the year 2004. The right of the petitioner flows from the direction issued by the Hon'ble Supreme Court from time to time. There is adequate material on record to show that the petitioner had not qualified the physical test, when the first round of recruitment process was gone through. He had approached the High Court earlier. He was given an opportunity to re-establish the factum

Patna High Court CWJC No.13050 of 2014 dt.14-09-2016 2/2 that the previous measurement was wrong. Nothing has changed despite the second opportunity.

If this be so, there cannot be any direction in favour of the petitioner to participate in the written examination on the basis of the outcome of the previous exercise where the petitioner had failed and continues to fail to meet the physical standards.
