1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Ahiyapur P.S. Case No. 678 of 2023 corresponding to G.R. No. 2851 of 2023 dated 01.06.2023 registered under Sections 341, 323, 325, 307, 379, 504, 34 of the I.P.C.
3. As per the First Information Report on 31.05.2023 in the morning the informant arrived at the house of petitioner for demanding his money back. In the meanwhile, the petitioner along with other accused persons assaulted him. The petitioner assaulted the informant by means of iron rod on his head.
4. Learned counsel for the petitioner submits that petitioner is having no criminal antecedent and there was dispute regarding
Patna High Court CR. MISC. No.30579 of 2024(2) dt.02-08-2024 2/3 money between the parties. It has further been submitted that all family members have been made accused. The other family member of the petitioner namely, Binod Ram has been granted anticipatory bail by this Court in Cr. Misc. No. 64163 of 2023. No serious injury has been caused to the victim due to assault made by the petitioner as would be evident from the impugned order.

Regard being had to the submission made by the parties, taking into consideration the fact that occurrence has taken place between informant and the petitioner due to money dispute, the co-accused has been granted anticipatory bail by this Court and serious injury has not been caused to the informant, as such, I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur / concerned court in connection with Ahiyapur P.S. Case No. 678 of 2023 corresponding to G.R. No. 2851 of 2023 subject to the condition as laid down under
