JUSTICE SUDHIR SINGH ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 147, 148, 149, 201, 323, 353, 382 and 511 of the Indian Penal Code.

Allegation against the petitioner is that he along with other accused persons after scuffling with the police forces and snatching their weapons took away the dead body of the deceased, who died due to non-fulfillment of dowry, with a view to help the F.I.R. named accused persons for screening of evidence of dowry death.

It is submitted on behalf of the petitioner that he has got no criminal antecedent. From perusal of the F.I.R. it appears that twenty named persons including hundred unknown persons are said to have participated in the alleged occurrence. No specific allegation has been made against the petitioner. General and omnibus allegation has been levelled against all the accused persons. The other co-accused have been granted anticipatory bail vide Cr. Misc. no. 45739 of 2015.

On behalf of the State, it is submitted that petitioner is

Patna High Court Cr.Misc. No.50537 of 2015 (3) dt.09-02-2016 2/2 named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri S. K. Srivastava, learned Judicial Magistrate, Ist Class, Raxaul at Motihari, in connection with Chhauradano P.S. Case no. 99 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
