1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Learned counsel for the petitioner seeks permission to withdraw the quashing application with liberty to raise all the issues at the time of framing of charge as it has been submitted that though cognizance was taken in the year 2002 but till date the case is still pending at the stage of cognizance. The dispute basically was a money dispute and the parties have compromised as would be evident from Annexure-2 to the quashing application. It is further submitted that after the O.P. No.2 received his entire payment, he has stopped appearing in the case on account of which the case has remained pending. It
Patna High Court CR. MISC. No.56777 of 2015(2) dt.31-08-2023 2/2 is next submitted that even offences of which cognizance has been taken are compoundable under Section 320 of the Cr.P.C.
3. Permission is accorded with the liberty aforesaid.
4. Accordingly, the present quashing application is dismissed as withdrawn.
