JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No.1090(C) of 2014 in which cognizance has been taken under Section 498A IPC and Sections 3/4 of Dowry Prohibition Act Earlier the matter was referred to the Patna High Court Mediation and Conciliation Centre vide order dated 20.2.2019 and the Mediator's report at Flag 'Z' shows that the parties have resolved their dispute through the process of mediation in terms of settlement mutually agreed upon between them and in terms of settlement both the parties are ready to live separately and petitioner has paid Rs.2,25,000/- to opposite party No.2 as permanent alimony through Demand Draft of Bank of Maharashtra which has been received by opposite party No.2.

In view of above facts and circumstances, let petitioner surrender in the court below on 26.7.2019 and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Bhojpur at Ara, in connection with Complaint Case No. 1090(C) of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned. It is expected that both the parties will abide by the terms and condition of agreement mutually agreed upon between the parties. Let the report of Mediator along with the memorandum of agreement be sent to the court concerned for needful. (Vinod Kumar Sinha, J) spal/- U T
