In the present case, the petitioner is apprehending his arrest in connection with Agamkuan P.S. Case No. 366 of 2016 for offence under Sections 366(A) of the Indian Penal Code. The statement of the girl itself shows that she has gone with the petitioner on her own volition. There was neither any coercion on the part of the petitioner nor this is a case of abduction of a girl. Both of them have entered into marriage and are living together.

Looking to the entire facts and circumstances of the case, let the petitioner, namely, Shishu Pal Mahto @ Shishu Pal Kumar, in the event of his arrest or surrender before the court

Patna High Court Cr.Misc. No.24004 of 2017 (2) dt.01-07-2017 below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna in connection with Agamkuan P.S. Case No. 366 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been cancelled.
