In this case, the petitioner is apprehending his arrest in connection with Excise Case No. 40 of 2019 registered for offences under sections 30(a) and 38(2) of the Bihar Excise Prohibition Act, 2016.

As per prosecution story, the excise officials, on receipt of secret information, made a raid on the newly constructed house and recovered huge quantity of illegal foreign liquor (Total 441.360 liters) from there. It has been alleged that the accused persons, seeing the excise officials, managed to escape from the place of occurrence whose names have been disclosed by the local public as Rakesh Kumar, Mithun Yadav,

Looking to the recovery of huge quantity of illegal liquor, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner, above named, rejected.

If the petitioner surrenders before the court below within a period of three weeks from today and prays for bail, the court below, without being prejudiced by this order, will take a decision in accordance with law.
