====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 02-03-2022 Heard leaned counsel for the petitioner and learned APP for the State.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120(b), 196, 197, 198, 199 and 201 of the Indian Penal Code.
Prosecution case is that in course of examination of documents by BSEB, Patna for appointment of petitioner as a Teacher and it was found that the BETET marks sheet of the petitioner was false and fabricated. The original BETET sheet serial number of the petitioner, namely, Pinki Kumari is 000984, father's name Shankar Prasad Bhagat and she obtained 82qualified but a tampering was found in folder file no.5051,
Patna High Court CR. MISC. No.32961 of 2021(2) dt.02-03-2022 2/3 BETET serial no. 124746, father name Krishnandeo Prasad and the marks obtained is 110- qualified, as such, the petitioner has created forged document by tampering in BETET original mark sheet and produced a fake marks sheet.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that at the time of appointment, her entire documents have been verified by the appointing authority and has not found any forgery with the certificates and her markssheet was found genuine and thereafter a merit list has been prepared and she has duly been appointed as Primary Teacher. He further submits that the petitioner was a lady and has been dismissed from the service on the ground of tampering of certificate.
Learned APP appearing for the State has opposed the prayer for anticipatory bail.
In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Sherghati,
