19-01-2017 Heard Sri Jagannath Singh, learned counsel for the petitioner and Sri Chandra Mohan Singh, learned counsel for the opposite party/Bihar Agriculture University.

The present petition has been filed with a prayer to restore C.W.J.C. No. 19232 of 2013 in respect of respondent no. 7 to 41. The writ petition stood dismissed against those respondents due to non-compliance of peremptory order dated 26-11-2013. By the said order, while directing for issuance of notice to respondent no. 7 to 41 of the writ petition, direction was given to file requisites within two weeks. Notice was to go through ordinary post as well as registered cover.

Learned counsel for petitioners, by way of referring to statement made in present petition, submits that due to inadvertence, the order dated 26-11-2013 was partly complied

Patna High Court MJC No.205 of 2014 (3) dt.19-01-2017 2/2 with and requisites were filed only for registered cover. However, after noticing the fact that petition stood dismissed due to part non-compliance of the order in respect of respondent no. 7 to 41, the petitioners have already filed requisites for issuance of notice through ordinary process.

In view of facts and circumstances, let C.W.J.C. No. 19232 of 2013 be restored to its original file in respect of respondent no. 7 to 41.

Office is required to utilize the requisites, which were filed earlier.
