JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-07-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Semra (Chiutaha) Police Station Case No. 30 of 2017, disclosing offences under Sections 304B/34 of the Indian Penal Code.
The petitioner no. 3 is father-in-law of the deceased; whereas, petitioner nos. 1 and 2 are wives of the brothers of the husband of the deceased.
It is submitted on behalf of the petitioners that so far as petitioner nos. 1 and 2 are concerned, they were
Patna High Court Cr.Misc. No.27198 of 2017 (2) dt.01-07-2017 2/3 living separately on the date of occurrence and they had no concern with the deceased or the family of the deceased. Referring to the case of petitioner no. 3, it has been submitted that he is an old man and there is no specific allegation against him of demand of dowry or torture therefore.
Considering the above submissions, this application is allowed.
Let the petitioners, namely, Rajani Devi, Pinki Kumari @ Pinki Devi @ Rinki Kumari @ Rinki Devi and Khajanti Prasad Sah @ Khajanti Sah, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bagaha, West Champaran, in connection with Semra (Chiutaha) Police Station Case No. 30 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds
Patna High Court Cr.Misc. No.27198 of 2017 (2) dt.01-07-2017 3/3 shall be liable to be cancelled.
