This application for anticipatory bail arises out of Ara Nagar P.S. Case No. 437 of 2018, disclosing offences punishable under Sections 341,323,354,498A/34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act. The petitioner and Opposite party No.2 were married on 24.04.2016. It is alleged that the petitioner and his family members are demanding dowry and torturing Opposite party No.2 for non fulfillment of the said demand.

Learned counsel for the petitioner has argued that apparently the matrimonial dispute is the reason behind lodging

Patna High Court CR. MISC. No.21753 of 2020(11) dt.17-03-2021 2/2 of the First Information Report and considering the nature of accusation, there is no chance of the petitioner fleeing from the course of investigation or trial.

Learned counsel for the Informant has vehemently opposed the prayer for grant of anticipatory bail. On perusal of the First Information Report and other materials on record, in my opinion, a case for grant of anticipatory bail is made out.

The provisional bail granted to the petitioner by order dated 14.08.2020 in Ara Nagar P.S. Case No. 437 of 2018, pending in the Court of learned Chief Judicial Magistrate, Bhojpur at Ara, is, hereby, confirmed.

It will be open for the parties to approach appropriate forum for one time settlement, in accordance with law. (Chakradhari Sharan Singh, J) arun/- U
