The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 379, 385, 427 and 307/34 of the Indian Penal Code. The prosecution case is that on 09.03.2016 at 5.00 P.M. the informant was going to Jadia on his auto rickshaw when the petitioner along with one Niranjan Yadav alias Fouzi surrounded his auto rickshaw, started abusing and demanded rupees five hundred as extortion. On protest being made the petitioner and the co-accused assaulted with iron rod and took out rupees twelve thousand and driving licence of the informant. The petitioner pushed auto rickshaw of the informant.

No.28121 of 2016 (2) dt.11-07-2016 2/2 It is submitted by learned counsel for the petitioner that for a petty dispute the accusation has been levelled and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The injury report of the informant suggests scratch on the nose and tenderness in the back. Both the injuries have been found to be simple in nature.

Considering the nature of accusation and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Supaul in connection with Jadia P.S. Case No. 24 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
