ANJANA PRAKASH ORAL JUDGMENT Date: 08-04-2016 The petitioner seeks cancellation of bail granted to the Opposite Party no. 2 by order dated 26.11.2011 passed by In-charge Sessions Judge, Begusarai in B.A. No. 1870 of 2011 in connection with Begusarai Mufassil P.S. Case No. 306 of 2011 on the ground that he has indulged in similar activities.

The Opposite Party no. 2 submits that in fact till date no processes have been issued in the cases mentioned and he has not been declared absconder and is therefore required to appear in Court.

In view of such, the application is disposed off with direction to the Officer-in-charge, Mufassil Police Station, Begusarai to keep a watch on the activity of the Opposite Party no. 2 and if it is

Patna High Court Cr.Misc. No.37909 of 2012 dt.08-04-2016 2/2 found that he is indulging in anti- social activity he shall file a report in the Court concerned and the Court shall thereafter take appropriate steps against him.

The trial Court is also directed to conclude the trial positively within a period of five months from the date of receipt of a copy of this order without granting any unnecessary adjournment to any party the Trial Court is directed to send a list of remaining witnesses/ the witnesses fixing specific dates for production of the witnesses along with a copy of this order, to the Superintendent of Police, concerned and the Superintendent of police, concerned is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
