JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-10-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 328, 302 of the Indian Penal Code.

As per the prosecution case, one Ravi Kumar of D.S. College, Katihar is alleged to have committed the murder of the deceased.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Petitioner is not named in the FIR. The name of petitioner has transpired in this case during the course of investigation in the statement of son of deceased who raised suspicion that petitioner had some affair with the deceased and might have killed his mother. Save and except this there is no other

Patna High Court CR. MISC. No.35619 of 2021(3) dt.25-10-2021 2/2 material against this petitioner to show his complicity in the aforesaid crime. Petitioner claims clean antecedent and is in custody since 06.01.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Kotwali PS case No. 246/ 2005.
