2. The petitioner seeks bail in connection with Shampur PS Case No.11 of 2024 dated 14.03.2024, instituted for the offence punishable under Sections 149, 341, 323, 324, 326-A, 302, 504,120-B of the Indian Penal Code.
3. The prosecution case, in brief, is that on 13.03.2024, the deceased went to his Sasural to bring his wife which despite his request was denied and all the FIR named accused persons including the petitioner brutally assaulted due to which he sustained serious injuries which let to his treatment during the course of treatment.
4. Learned counsel for the petitioner submits that there is no specific allegation against the petitioner, rather,

It is further that the petitioner is a distant relative of wife of the deceased and only on account of this he has been implicated in this case. It is further submitted that similarly situated coaccused Md. Arbaj @ Md. Arif and Vakruddin @ Vakrid Alam @ Vakrie have been granted bail by order dated 10.01.2025 passed in Cr. Misc. No. 89123 of 2024 and order dated 28.02.2025 passed in Cr. Misc. No.11410 of 2025 respectively by a co-ordinate Bench of this Court. Lastly, it is submitted that the petitioner is in custody since 24.02.2025 having two criminal cases pending against him.
5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger, in Shampur PS Case No.11 of 2024, subject to the conditions (i) that the petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court

No.25179 of 2025(2) dt.30-04-2025 3/3 below, (ii) that one of the bailors will be his own blood relation, preferably father, mother, brother, sister and or his wife, (iii) that the bailor shall also state on affidavit that he will inform the court concerned if the petitioner is made accused in any other case of similar nature after his release in the present case and thereafter the court below will be at liberty to initiate the proceeding for cancellation of bail on ground of misuse, and (iv) that if the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
7. The application stands allowed.
