ANJANA MISHRA ORAL ORDER 28-01-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 22.03.2018 in connection with Katoriya P.S. Case No.171 of 2017 giving rise to Session Trial No.213 of 2018, registered for the offence under Sections 341, 323, 324, 307, 427, 504, 379, 302 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has alleged to have attacked the son of the samdhi of the informant and the allegation against him is of giving a danda blow on the head of the one Guddu Yadav. Learned counsel for the petitioner further submitted that the similar allegation is also against another brother of the petitioner, namely, Bandhu Yadav who has since been extended the

Patna High Court Cr.Misc. No.78508 of 2018(2) dt.28-01-2019 2/2 privilege of regular bail in Cr.Misc. No.23161 of 2018 vide order dated 19.04.2018. It is further submitted that the bail application of the main accused Supari Yadav has already been rejected by the same order.

Learned counsel for the informant is also present and submits that there was also an injury on the son of the deceased which is evident from the FIR itself.

However, considering the fact that the petitioner's case stand on similar footing with Bandhu Yadav and that the petitioner has got no criminal antecedent, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Banka, in connection with Katoriya P.S.
