The petitioner apprehends her arrest in Begusarai Moffassil P.S. Case No. 68/2015, registered for the offences punishable under Section 302 and other sections of the Indian Penal Code.
The informant brother of the deceased alleged that Kanhaiya Singh took his brother in the night of 04.03.2015 in the house of Munni Devi and assaulted. His brother was found lying unconscious on the machan of Kaushal Singh.
It is submitted that there is no eye-witness of the occurrence that Kanhaiya Singh took the brother of the deceased in the house of Munni Devi and assaulted him and the dead body
Patna High Court Cr.Misc. No.22006 of 2015 (3) dt.08-10-2015 2/2 was found on the machan of Kaushal Singh. Nobody said that Kanhaiya Singh assaulted the deceased in the house of the petitioner. There is absolutely no material against the petitioner to show that the petitioner was also involved in the killing of the brother of the informant. Except suspicion there is no material. The investigating officer has also not collected any tangible material.
Considering the facts aforesaid, the petitioner, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Moffassil P.S. Case No. 68/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
