02. 07.09.2016 Heard parties.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code. It is contended on behalf of the petitioner that the title suit is pending between the parties and injuries are on both sides. Nineteen persons have been named in the First Information Report and most of them belong to the same family. It is further contended that so far as the allegation of assault on the head of the Informant causing grievous injury is concerned, the petitioner and Navin Singh both of them have been alleged to have assaulted on the head but the injury is only one, thus, it

It is also submitted that several accused persons have been granted bail by the court below itself and eight of them have been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 11.03.2016 passed in Cr. Misc. No. 6548 of 2016.

Having regard to the facts and circumstances of the case, let the petitioner, namely, Vikram Yadav be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with K. Asthan P.S. Case No. 274/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga subject to the conditions as laid down under subsection (2) of Section 438 of the Code of Criminal Procedure.
