Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State through video conferencing.

The petitioner apprehends his arrest in connection with Phenhara P.S. Case No. 01/2020 registered for offence punishable under sections 147, 149, 341, 323, 307, 379, 504 and As per allegation, the accused persons named in the FIR came to the field of the informant and co-accused Damodar Singh and Devendra Singh assaulted him with iron rod. The

Patna High Court CR. MISC. No.32714 of 2021(2) dt.01-04-2022 2/2 allegation against the petitioner is also of assaulting with iron rod on the head of the informant.

The learned counsel for the petitioner has submitted that there is land dispute between the parties and the injuries are simple in nature.

Considering the above-mentioned facts and circumstances as well as the clean antecedents of the petitioner, let the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Phenhara P.S. Case No. 01/2020, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
