====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 07-09-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Mahesi P.S. Case No. 57 of 2015 registered for the offences punishable under Section 394 of the Indian Penal Code.

Case diary, in the present case, was called for which has since been received.

The learned counsel for the petitioner submits that though the petitioner is not named in the First Information Report, but subsequently in the statement made by one of the witnesses, who is said to have been standing at the chowk, the petitioner's name has come stating that they had followed the motorcycle. However, the occurrence is said to have taken place at the middle

Considering the aforementioned facts and circumstances of the case, save and except, the statement made by the witnesses in paragraph 30 of the case diary that there is no further cogent material against the petitioner and in view of the fact that petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Saharsa in connection with Mahesi P.S. Case No. 57 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
