JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-10-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Janta Bazar P.S. Case No. 10 of 2015 registered under Sections 147, 148, 149, 341, 323, 324, 307, 506 and 504 of the Indian Penal Code.

The accusation is that petitioners, including six others reached at the informant and petitioner no.3 Ram Saran caused injury through knife at the head of the informant Ashdeo Panday, petitioner no.2 Tiku Kuer caused injury to Laldeo Pandey and petitioner no.1 caused injury at the head of Amrendra Kumar Pandey.

Patna High Court Cr.Misc. No.42651 of 2015 (2) dt.08-10-2015 2/2 Learned counsel appearing on behalf of the petitioners submits that in fact, the occurrence took place due to land dispute and the injury found on the persons of the informant Ashdeo Pandey, Amrendra Pandey and Laldeo Pandey were found simple in nature. Moreover, the defence party has also sustained injury, regarding which Janta Bazar P.S. Case No. 11 of 2015 was instituted on the basis of statement of Kailash Kuer, one of the coaccused. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M., Saran at Chapra in connection with Janta Bazar P.S. Case No. 10 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J.) Shail/- U T
