The petitioner seeks bail in connection with Maniyari P.S. Case No. 34 of 2019 arising out of Maniyari P.S. Case No. 34 of 2019 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.
The accusation is that during course of patrolling duty, when the police team reached near Bhuganji Chowk, two persons started fleeing away. On chase, one person with scooty was apprehended who disclosed his name as Sanoj Kumar Das (petitioner) but other person succeeded in fleeing away. On search, 14 bottles each containg 375 ml. and 111 bottles each
Patna High Court CR. MISC. No.23610 of 2019(2) dt.12-04-2019 2/2 containing 180 ml. foreign liquor was recovered from the scooty.
The learned counsel appearing on behalf of the petitioner submits that in fact, the petitioner was in the way and he took the lift to a person who was driving the scooty but he managed to flee away. Petitioner had no knowledge about the keeping of liquor in scooty. He has no criminal antecedent and is in custody since 18.02.2019.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Maniyari P.S.
