====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-07-2017 Heard the learned counsel for the petitioners. The petitioners seek anticipatory bail in connection with Chandauti P.S. Case No. 25 of 2017, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 506 (B) of the Indian Penal Code. It has been alleged that the accused persons had stopped the tempo of the son of the informant and assaulted him. Thereafter, on the next day i.e. 10.02.2017 the accused persons are said to have assaulted the informant and snatched a sum of Rs. 1700/- from his pocket.
The learned counsel for the petitioners submits that there is no allegation of any overt act against the petitioners, admittedly, there is land dispute between the parties and there is a
Patna High Court Cr.Misc. No.32523 of 2017 (2) dt.13-07-2017 2/2 counter case lodged by one of the accused persons. It is submitted that the petitioners have clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to grant anticipatory bail to the petitioners.
Accordingly, in the event of their arrest or surrender in the Court below within a period of four weeks from today, let the above named petitioners be enlarged on bail on furnishing bailbonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Chandauti P.S. Case No. 25 of 2017 subject to the conditions laid down under Section 438(2) Cr. P. C. (Mohit Kumar Shah, J) BTiwary/- U T
