Patna High Court CR. MISC. No.32726 of 2021(4) dt.07-04-2022 2/3 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Mohania P.S. Case No. 170 of 2019 registered for offence punishable under sections 341, 323, 379, 504, 506/34 of the Indian Penal Code.
As per allegation, when the informant was harvesting his wheat crops, four FIR named accused persons came there and assaulted the informant. The allegation against the petitioner Shani Kumar is that he badly assaulted the informant, who sustaining injury, fell down on the ground. The petitioner Shani Kumar also assaulted the brother of informant, Jitendra Kumar Singh on his right hand and waist with lathi. The learned counsel for the petitioners has submitted that both the parties are agnates. There is previous land dispute between both the parties and petitioners' side also lodged the case against informant's side. He has submitted further that injuries, sustained by the informant Upendra Singh, is simple in nature.
Considering the above-mentioned facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, be

No.32726 of 2021(4) dt.07-04-2022 3/3 released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S. Case No. 170 of 2019, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
