The petitioner seeks bail in connection with Shahpur P.S. Case No. 05 of 2020, dated 06.01.2020, instituted for the offences under Sections 380 and 457 of the Indian Penal Code.

The petitioner is not named in the F.I.R. and his implication in this case is on the basis of confession of one Suraj Choudhary. On the basis of aforesaid confession, there was recovery of mobile phone and other computer peripherals from the house of one Ajay Ram.

It has been submitted on behalf of the petitioner that aforesaid Suraj Choudhary has been granted bail by the Court below. The person from whose possession stolen articles have been recovered has also been granted bail by the Court below.

The petitioner is stated to be in custody since 18.01.2020 and he does not have any criminal case against him apart from the present one.

Considering the facts afore-stated, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Chief Judicial Magistrate, Bhojpur at Ara in connection with Shahpur P.S. Case No. 05
