ANJANA MISHRA ORAL ORDER 11-01-2017 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Kanti P.S. Case No. 533 of 2015 for the offences registered under Sections 447, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioners submits that admittedly, the occurrence, with regard to which the present first information report has been lodged in the year 2015, is of 13.11.2008 and the first information report has been registered seven years thereafter, for which no plausible explanation has been offered for such delay.

Considering the fact that the first information report was not lodged at the relevant point of time and has come up now only at the time of election, let the petitioners, above named, in the

Patna High Court Cr.Misc. No.33739 of 2016 (4) dt.11-01-2017 event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., West Muzuffarpur in connection with Kanti P.S. Case No. 533 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
