The petitioner apprehends his arrest in Obra P.S. case No. 58 of 2016 under Section 409, 420 of the Indian Penal Code. The petitioner being Chairman of Dihara PACS took Rs. 32,64,000/- for purchasing paddy in the financial year 201415. The petitioner gave paddy but still Rs. 22,23,244.36 is lying due against the petitioner till 30.11.2015.

Sri Krishna Prasad Singh, the learned senior counsel for the petitioner, submits that petitioner is ready to return the entire amount in four equal installments within eight months, subject to interest accrued thereon. The petitioner shall deposit

Considering the undertaking given by the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Daudnagar (Aurangabad) in Obra P.S. Case No. 58 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

If the petitioner fails to deposit any installment in time, the learned court below shall immediately cancel the bail bonds of the petitioner.
