Petitioner seeks bail in Sono P.S. Case No.274 of 2018 instituted for the offence under Section(s) 272, 273 Indian Penal Code and Sections 30(a), 41 of Bihar Prohibition and Excise Act, 2016.

It is alleged that total 140 litres foreign liquor has been recovered from the Bolero vehicle. Driver of the vehicle is alleged to have run away, whereas, petitioner was found to be sitting in the aforesaid vehicle.

Counsel for the petitioner submits that Petitioner is in custody since 06.10.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner,

Patna High Court Cr.Misc. No.79201 of 2018(2) dt.30-01-2019 2/2 above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, 2nd, Jamui, in connection with Sono P.S. Case No.274 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.

It appears that one more case under the Excise Act is pending against the petitioner. The petitioner will file an Affidavit at the time of his release that he will not indulge in such activities in future, otherwise, his bail bond in the instant case will be liable to be cancelled.
