This application is for grant of regular bail in connection with Nokha P.S.Case No.203 of 2018 for the offences under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is about recovery of 26 litrs. of liquor from the Khalihan and the petitioner is named in the FIR along with the other accused persons. Petitioner is accused in four other cases.
Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and the Khalihan is not of the petitioner. He has falsely been made accused in four other cases but he is on bail in those cases.
Patna High Court CR. MISC. No.24423 of 2019(4) dt.22-05-2019 2/2 Heard learned A.P.P. , who has opposed the prayer for bail stating that the recovery is in huge quantity of liquor as well as he is accused in four other cases.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer for bail. With the aforesaid observation, this application is dismissed.
