The petitioner apprehends his arrest in Laukaha (Lalmuniya OP) P.S. Case No. 283 of 2021, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner assaulted the informant with Fattha, Bricks as a result of which he sustained grievous injury.

It is submitted that both parties are agnates and due to land dispute the alleged occurrence took place. As per the injury report, injury caused by hard and blunt substance, but not on vital part of the body. There is delay of fifteen days in lodging of the FIR for which no explanation was given.

Patna High Court CR. MISC. No.24786 of 2022(2) dt.13-09-2022 2/2 Considering the facts aforesaid and nature of injury, I am not inclined to enlarge the petitioner above-named on anticipatory bail.

Accordingly, the prayer for anticipatory bail is rejected.
