The petitioners apprehend their arrest in connection with Complaint Case No.632(c) of 2021, registered for the offence punishable under Section 498(A) of the Indian Penal Code. The petitioners are said to have tortured the complainant physically and mentally for non-fulfillment of demand of additional dowry.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the
Patna High Court CR. MISC. No.24726 of 2022(2) dt.31-08-2022 2/2 present case. The petitioners have got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that there is general and omnibus allegation against all accused persons. Petitioner No.1 is the father-in-law and petitioner no.2 is the mother-in-law of the complainant. Petitioner No.3 is the covillager. The petitioner has relied upon the judgment of this Court in the case of Md. Naimul Haque Ansari @ Naimul Haque Ansari & Ors. Vs. The State of Bihar, reported in 2006 (3) PLJR 182.
Taking into consideration the fact that there is general and omnibus allegation against the petitioners, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabhua in connection with Complaint Case No.632(c) of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
