The petitioner seeks bail in Adhoura P.S. Case No. 46 of 2018 registered under Section 307 of the Indian Penal Code and Section 27 of the Arms Act.

Some unknown miscreants resorted firing on the son of the informant on way to school and during the course of investigation after going through the call details it has come that the petitioner and another accused persons were in touch with the main accused, namely, Hari Yadav.

It is submitted by learned counsel for the petitioner that the no such occurrence as alleged ever took place. The petitioner has committed no offence. He has no concern with the aforesaid

The petitioner is neither named in the F.I.R. nor he was apprehended on the spot. No test identification parade was conducted. He has no concern with the accused Hari Yadav. Similarly situated coaccused, namely, Lalita Yadav has been enlarged on bail by a co-ordinate bench of this Court vide order dated 15.01.2019 passed in Cr. Misc. No. 79649 of 2018. The petitioner has been languishing in custody since 06.11.2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Kaimur, Bhabua in connection with Adhoura P.S. Case No.46 of 2018, G.R. No.1861/18. (Prakash Chandra Jaiswal, J) Trivedi/- U T
