The petitioner seeks bail in connection with Baheri P.S. Case No. 46 of 2020, dated 18.02.2020, instituted for the offences under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)A, 26 and 35 of the Arms Act. It appears that from the possession of the petitioner a looted country made pistol and four cartridges

Patna High Court CR. MISC. No.21761 of 2020(2) dt.08-07-2020 2/2 have been recovered.

It has been submitted on behalf of the petitioner that only because he was earlier made accused in a case, the local police is against him and, therefore, he has been made accused in the present case.

The petitioner is in custody since 19.02.2020. Regard being had to the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-IX, Darbhanga in connection with Baheri P.S. Case No. 46 of 2020.

The application stands allowed.
