Petitioner seeks regular bail in connection with Mokama P.S. Case No. 52 of 2018 registered for the offence under Sections 147, 148, 149, 335, 336, 307, 427 of the I.P.C. Allegation as per the first information report is that one tractor was parked in front of the house of the informant and suddenly it caught fire. It has further been alleged that in the meanwhile the Aunt of the informant woke up and saw petitioner along with other accused persons fleeing away from the place of occurrence. It has also been alleged that when the informant and others were engaged in extinguishing the fire, the accused persons started indiscriminate firing upon them due to which informant received fire arm injury in his left hand. Learned counsel for the petitioner submits that from

No.33772 of 2021(2) dt.03-01-2022 2/2 perusal of the First Information Report it would be evident that the allegation against the petitioner is general and omnibus in nature. He further submits that there is previous enmity between the informant and the accused persons, which would be evident from the First Information Report. He next submits that petitioner is in custody since 07/09/2020 and charge sheet has already been submitted.

Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that there is no specific allegation against the petitioner, petitioner is in custody since 07/09/2020 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Barh (Patna) in connection with Mokama P.S.
