The writ application was filed with a grievance that although the petitioner has applied for grant of pension under Lok Nayak Jai Prakash Narayan Samman Pension Yojana ( for short 'Yojana') as he was political captive under MISA and remained in jail custody at Central Jail, Gaya for the specified period. Counter affidavits on behalf of the respondent nos. 1 and 2 as well as 4 are filed. There is no rejoinder. The counsel for the State, relying on the averments made in paragraph nos. 6 and 7 of the counter affidavit filed on behalf of the respondent nos. 1 and 2, has contended that in

Patna High Court CWJC No.5394 of 2014 (2) dt.04-10-2016 2/2 consideration of the papers filed along with the claim submitted by the petitioner, he has been sanctioned pension at the rate of Rs. 5000/- per month under the said Yojana.

Seen thus, it appears the grievance of the petitioner has been redressed. The application is dismissed as having become infructuous.
