The petitioners apprehend their arrest in Darauli P.S. Case No. 188 of 2015, registered for the offences punishable under Sections 364 and 34 of the Indian Penal Code. The informant alleged that on 17.11.2015 Renu Kumari, daughter of Hareram Harijan took his son Deepak Kumar to her house. Deepak Kumar was apprehended by Hareram Harijan, his wife and son but thereafter the son of the informant is traceless.
Learned counsel for the petitioners submits that the petitioners are wife, daughter and son of Hareram Harijan. Deepak Kumar, son of the informant was apprehended by Hareram
Patna High Court Cr.Misc. No.34418 of 2016 (3) dt.19-10-2016 2/2 Harijan along with Renu Kumari outside the village and thereafter Deepak Kumar fled away from there to Pune. The petitioners never kidnapped the son of the informant.
It appears that the informant made allegation that the son of the informant was taken by Renu Kumari, daughter of Hareram Harijan to her house and thereafter the son of the informant is traceless. The informant further alleged that all the accused persons kidnapped his son. During course of the investigation it has come that the victim is still traceless. Considering the nature of allegation made against the petitioners, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected.
