JUSTICE RAVI RANJAN ORAL ORDER 11-07-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 337, 307, 354(A) (B), 379, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is contended that on behalf of the petitioner that it is apparent from the FIR that this occurrence is outcome of political rivalry between two groups during course of election of Mukhiya in which the allegation has been made upon three persons including the petitioner of trying to outrage the modesty of Chunni Devi which is merely ornamental in nature as the same naver happened.

Having regard to the facts and circumstances of the

No.26356 of 2016 (2) dt.11-07-2016 2/2 case, let the petitioner, namely, Rakesh Mistri be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Asthawan P.S. Case No.54/2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Nalanda at Biharsharif subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
