The petitioner seeks bail in Rampur P.S. Case No. 42 of 2020 corresponding to Sessions Trial No. 412 of 2021, registered for the offence punishable under Sections 419, 420 and 120(B) of the Indian Penal Code and section 10 of Examination Conduct Act.

As per the prosecution case, one co-accused Saurav Kumar was found sitting in place of this petitioner in intermediate examination, 2020 at Gaya College, Gaya. It is submitted on behalf of the petitioner that petitioner has not been apprehended on the spot and he has been dragged in this case on the basis of confessional statement of

Patna High Court CR. MISC. No.34121 of 2021(2) dt.06-01-2022 2/2 co-accused Saurav Kumar. Admit card of petitioner was stolen by co-accused Saurav Kumar and without his knowledge and consent appeared in the examination. Petitioner is in custody since 09.03.2021 having clean antecedent.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Gaya in connection with Rampur P.S. Case No. 42 of 2020.
