The petitioner seeks bail in Budha Colony P.S. Case No. 420 of 2018 registered under Section 376/511 of the Indian Penal Code.

The petitioner happens to be son of the landlord and tried to outrage the modesty of the informant intruding into the rented room of the informant who assaulted him by means of knife inflicting injury on his hand, finger and shoulder in private defence.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. The petitioner has committed no offence. Petitioner happens to be son of the landlord of the informant and there is arrear of rent against the

No.79301 of 2018(2) dt.18-01-2019 2/2 informant and on demand of rent by the petitioner she assaulted him by means of knife and to save her skin from the said occurrence has falsely implicated him in this case. There is no eye witness of the occurrence. The petitioner has been languishing in custody since 23.10.2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge-XVI-cum-Additional Chief Judicial Magistrate, Patna in connection with Budha Colony P.S.
