Petitioner seeks bail in G.B. Nagar P.S. Case No. 158 of 2018 registered for the offence punishable under Sections 341, 323, 326, 379, 307, 498A and 34 of the Indian Penal Code and under Section 3/4 of the D.P. Act and later on 304 B has been added.
Informant has alleged that petitioner (husband) assaulted and ousted her from her matrimonial house due to non-fulfillment of demand of dowry. It has been further alleged that petitioner on 25.05.2018 set her ablaze and thereafter took her in hospital and fled away along with his family members. Her statement was recorded by executive magistrate and
Patna High Court CR. MISC. No.78334 of 2018(4) dt.08-03-2019 2/2 thereafter she died.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. He was not present at the place of occurrence. Deceased herself set her ablaze. Petitioner has got no criminal antecedent and is in custody since 07.06.2018.
Considering direct allegation against petitioner abusing, assaulting and setting ablaze his wife (informant) who subsequently died of burn injury, I am not inclined to enlarge the petitioner on bail, hence, the prayer for bail of the petitioner is hereby rejected.
