This application for anticipatory bail arises out of Mohiuddin Nagar P.S. Case No. 148 of 2018, disclosing offences under Sections 323, 341, 420, 504, 506 and 34 of the Indian Penal Code.

The informant was a bachelor. Allegedly, the coaccused Bhushan Rai and this petitioner approached him and assured the informant that they can arrange a girl for marriage, if he was ready to pay some money. The informant's mother is said to have paid a sum of Rs. 63,000/- to the co-accused Shanti Devi. It is alleged that, however, the marriage could not be materialized and they told about the girl that she had fled away.

Patna High Court CR. MISC. No.22167 of 2019(2) dt.09-04-2019 2/2 Considering the nature of allegation in the FIR, in my view, a case for grant of anticipatory bail is made out. Accordingly, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Samastipur in Mohiuddin Nagar P.S. Case No. 148 of 2018, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
