ANJANA MISHRA ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Phenhara P.S. Case No.24 of 2013, G.R. No.840 of 2013, for allegedly having committed the offence under Sections 406, 409, 420, 467, 468 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was the Headmaster of the School between the period January, 2009 and 30th September, 2010. It is further submitted that the construction of the building commenced in the year 2007 when the petitioner was posted as Assistant Teacher in the School. No.32050 of 2016 (3) dt.26-09-2016 2/3 posted as Headmaster of the School, but on his death, the petitioner became the Headmaster in January, 2009 and functioned as such till 1.10.2010. Thereafter, another person took over charge. It is further submitted that the petitioner had issued three cheques for the construction works of the School started by his predecessor Kameshwar Singh and thereafter from 1.10.2010 onwards, the subsequent Headmaster came to be responsible for the construction of the building. Thus, he submitted that the petitioner had earlier issued the cheque only for the work done during the period of his predecessor Kameshwar Singh. It is submitted that one co-accused Md. Kamaludin @ Kamaluddin Ahmad has been extended the privilege of anticipatory bail in Cr.Misc. No.

56763 of 2015, vide order dated 13.01.2016. Furthermore, other co-accused persons have also been extended the privilege of bail in Cr.Misc. No.21198 of 2014 and Cr.Misc. No.17580 of 2015.

Patna High Court Cr.Misc. No.32050 of 2016 (3) dt.26-09-2016 3/3 released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 12th Additional Chief Judicial Magistrate, East Champaran at Motihari, in connection with Phenhara P.S. Case No.24 of 2013, G.R. No.840 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
