The petitioner's appeal against the order dated 09.02.2021 passed by the Municipal Commissioner, Patna Municipal Corporation denying the petitioner benefits other than subsistence allowance is pending consideration before Respondent No 2. The petitioner, therefore, is aggrieved by pendency of the same for more than a year. It is stated that the appeal was filed on 21.03.2021.

Since the grievance is pendency of the appeal, this Court is not called for to adjudicate any issue as the appeal is yet to be decided by the appellate authority.

Patna High Court CWJC No.6785 of 2022(2) dt.12-12-2022 2/2 Writ petition, therefore, need not be kept pending. The same is being disposed of with a direction to Respondent No 2 to consider the petitioner's appeal and dispose it of by a reasoned and speaking order, in accordance with law within eight weeks from the date of receipt/production of a copy of this order, if the appeal has otherwise not been disposed of.
