Case No. as mentioned in paragraph 3 of the bail petition during course of the day.
Heard learned counsel for the petitioner and learned APP for the State.
The petitioner seeks bail in connection with Gaurichak P.S. Case No. 284 of 2018 registered under Sections 399/402 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.
Petitioner along with five other accused persons are said to have congregated at the Punpun Bandh to commit some occurrence and on the tip-off four accused persons including the petitioner were apprehended and from possession
Patna High Court Cr.Misc. No.79281 of 2018(2) dt.18-01-2019 2/3 of the petitioner, two live cartridges were recovered. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has no concern with the aforesaid occurrence. No incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern with the seized article. He happens to be student of Bachelor of Engineering (B.E.) and just regressed to his house after getting training and has been falsely implicated in this case at the instance of his enemy to ruin his career. Regarding the said occurrence, one more case has been lodged against the petitioner vide Gaurichak P.S. Case No. 285 of 2018 and petitioner has been enlarged on bail in the said case by a coordinate Bench of this Court vide order dated 17.01.2019 passed in Cr. Misc. No. 79947 of 2018. He has been languishing in custody since 21.08.2018.
Learned APP opposed the bail prayer of the petitioner.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned
