The present application has been preferred for quashing of the order dated 27.01.2023 passed by the learned Additional District & Sessions Judge-20, Muzaffarpur in Sessions Trial No. 312 of 2021 arising out of Katra P.S. Case No. 256 of 2020 under sections 147, 148, 149, 341, 323, 324, 307, 504 of the Indian Penal Code and section 25(1-B) a, 26, 27, 37 of the Arms Act.

3. At the outset, learned counsel for the opposite party no.2 submits that the trial is on and four witnesses have been examined. The Court has also perused the deposition of the different prosecution witnesses.

4. Since the trial is on, learned counsel for the petitioner submits that in that background, he may be permitted to withdraw the petition.
