The petitioner apprehends his arrest in Laxmipur P.S. Case No. 187 of 2015 registered for the offences punishable under Sections 307 and other Sections of the Indian Penal Code. Vijay Rabidas the informant named the petitioner along with other accused persons and alleged that they entered into his house and Pramod Kumar Das assaulted Pappu Rabidas with sword on his head. Matukdhari Das, Basant Rabidas and Bimal Rabidas, the petitioner also assaulted Pappu Rabidas with Lathi. It is submitted that Pappu Rabidas got injuries on his head caused by sharp edged weapon and the same is attributed to Pramod Kumar Das. Patna High Court Cr.Misc. No.29106 of 2016 (4) dt.29-09-2016 2/2 of Pappu Rabidas is opined to be grievous in nature. It is further submitted that co-accused Matukdhari Das has already been granted anticipatory bail vide order passed in Cr. Misc. No. 2113 of 2016 on 17.03.2016 by a coordinate Bench of this Court. Considering the facts aforesaid and the fact that the case of the petitioner stands on the same footing as that of Matukdhari Das, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Jamui in Laxmipur P.S. Case No. 187 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
