Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.

The petitioner is apprehending his arrest in Muzaffarpur Sadar P.S. Case No. 382 of 2020 registered under Sections 385, 387, 506/34 of the Indian Penal Code.

Allegedly, the accused persons including the petitioner were making firing outside the house of the informant and threatened to withdraw the earlier case filed by the informant. There is demand of extortion also.

It has been submitted on behalf of the petitioner that there

Patna High Court CR. MISC. No.33492 of 2021(3) dt.08-03-2022 2/2 is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. Due to previous enmity, the present case has been instituted. There are multiple litigations pending between the parties. No specific overt act is alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar P.S. Case No. 382 of 2020 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
