This is a petition for grant of anticipatory bail for offence under Sections 324 and 307 of the Indian Penal Code. Allegation against the petitioner is that for trivial dispute he fired at the informant. However, no injury was caused. Submission of the learned counsel for the petitioner is that it is easy to level such allegation and difficult to prove. In the circumstances, the petitioner, who has no criminal antecedent, deserves anticipatory bail.
I find substance in the submission of the learned counsel for the petitioner.
Let, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the
Patna High Court Cr.Misc. No.22211 of 2017 (3) dt.01-07-2017 2/2 like amount each in connection with Bakhtiyarpur P.S. Case No. 412 of 2016 to the satisfaction of the Chief Judicial Magistrate, Saharsa, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
