The petitioner is the husband of the complainant/informant. He is facing accusation punishable under section 498-A IPC. The marriage, indisputably, was solemnized 14 years ago.
It is submitted by the counsel for the petitioner that from perusal of the complaint, it would appear that on an application filed by the informant a sum of Rs. 5000/- and odd is being deducted from the salary of the petitioner and paid to her. The allegation of causing injury is superficial. The petitioner is always ready to maintain his wife even after his second marriage
Patna High Court Cr.Misc. No.21181 of 2017 (2) dt.01-07-2017 2/2 which was with the consent of the informant. For obtaining the privilege of anticipatory bail, he would be ready and willing to pay a consolidated amount as directed by the court. Considering the statement made at Bar and going through the materials on record, let the petitioner named above, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Ara, Bhojpur in Bhojpur Mahila P.S. Case No. 295 of 2016 on condition that one of the bailors of the petitioner shall be his own/close family member. Along with the bail bonds, the petitioner shall produce the evidence of payment/deposit of a sum of Rs. 5000/- in favour of his wife(informant).
